These terms and conditions apply to the use of the GratisGenieten platform, the website, mobile applications, vouchers, dining credit, reservations, cashback services and all other services of GratisGenieten.
By creating an account or using the platform, the user agrees to these terms.
1. About GratisGenieten
GratisGenieten is a marketing, loyalty and reservation platform that connects consumers with participating restaurants, webshops and campaign partners.
GratisGenieten does not sell meals itself, does not operate restaurants and does not act as a travel agency, hospitality business, financial service provider or payment institution.
Agreements relating to food, drink, reservations and restaurant services are concluded directly between the user and the restaurant.
2. Account
Users must provide correct and complete information.
The user is responsible for:
- keeping login details confidential
- all activity within the account
- keeping account details up to date
GratisGenieten may block, suspend or delete accounts in the event of:
- fraud
- misuse
- incorrect details
- multiple accounts
- manipulation of promotions
- misuse of vouchers
- breach of these terms
3. Dining credit and Wallet
Dining credit is promotional credit within the GratisGenieten platform.
Dining credit:
- is not money
- is not a bank account
- is not electronic money
- does not represent a claim against GratisGenieten
- cannot be paid out
- cannot be exchanged for cash
- can only be used within functionalities designated by GratisGenieten
GratisGenieten reserves the right to correct wallet balances in the event of:
- technical errors
- duplicate transactions
- returns
- fraud
- misuse
- administrative errors
No rights can be derived from wallet balances.
4. Cashback
Cashback arises from commissions GratisGenieten receives from affiliated affiliate networks, webshops and partners.
Cashback only becomes final after:
- the order has been completed successfully
- the return period has expired
- the webshop has approved the commission
- the affiliate network has confirmed the transaction
Transactions may be rejected due to:
- returns
- cancellations
- fraud
- tracking issues
- rejection by affiliate partners
- technical errors
GratisGenieten cannot guarantee that every purchase is registered.
Tracking depends on external parties including affiliate networks, browsers, devices, cookies and technical systems.
5. Vouchers
Vouchers are personal unless stated otherwise.
Vouchers:
- are not transferable
- are not for sale
- may not be copied
- may only be used once
- may have a limited validity period
Restaurants may refuse a voucher in the event of:
- fraud
- misuse
- expired vouchers
- incorrect details
- breach of terms
6. Reservations
Reservations are made directly with participating restaurants.
Restaurants decide for themselves:
- availability
- opening hours
- capacity
- conditions
- acceptance of vouchers
- participation in promotions
GratisGenieten does not guarantee that a restaurant is available at any time or accepts a reservation.
7. User's own responsibility
It is the user's responsibility to obtain clarity before consumption, ordering or payment about the acceptance of vouchers, dining credit, promotions and any additional conditions.
Although GratisGenieten strives for up-to-date information, availability, participation, conditions and acceptance of vouchers may change.
We therefore advise users to always verify with the restaurant which conditions apply before use.
If a user fails to carry out this check, GratisGenieten cannot be held liable for:
- refused discounts
- refused vouchers
- misunderstandings
- disappointments
- additional costs
- other consequences arising therefrom
Disputes about discounts, vouchers, promotions or restaurant conditions must be resolved directly between the user and the restaurant.
GratisGenieten is not a party to this.
8. No-shows and misuse
In the event of repeatedly not showing up for reservations or other misuse, GratisGenieten may:
- restrict reservations
- block vouchers
- correct wallet balances
- suspend accounts
- permanently close accounts
9. Restaurants
Participating restaurants remain independently responsible for:
- prices
- menus
- opening hours
- service
- food safety
- allergen information
- availability
- execution of promotions
- execution of discounts
- execution of vouchers
GratisGenieten gives no guarantee about the quality of products or services of restaurants.
10. Campaigns and QR promotions
GratisGenieten may organize promotions together with campaign partners such as shops, cinemas, event venues and other organizations.
Campaigns may:
- be temporary
- be regionally limited
- contain additional conditions
- depend on availability
GratisGenieten reserves the right to change or end campaigns at any time.
11. Marketing communication
If consent has been given, GratisGenieten may inform users about:
- offers
- campaigns
- restaurants
- cashback opportunities
- news
- events
Consent can be withdrawn at any time.
12. Intellectual property
All rights relating to software, websites, logos, trademarks, designs, images, texts and databases remain the property of GratisGenieten or its licensors.
Nothing may be copied, distributed or used commercially without prior written permission.
13. Technical availability
GratisGenieten strives for a well-functioning platform but gives no guarantees regarding:
- availability
- uptime
- error-free operation
- compatibility
- data transfer
- tracking
Failures at, among others, internet providers, cloud suppliers, affiliate networks, payment providers, restaurants and third parties fall outside the responsibility of GratisGenieten.
14. Liability
To the extent legally permitted, GratisGenieten is not liable for:
- indirect damage
- consequential damage
- loss of profit
- missed cashback
- missed reservations
- refused vouchers
- price changes
- allergies
- food poisoning
- restaurant closures
- errors of third parties
The total liability of GratisGenieten is limited to the amount that the user has actually paid to GratisGenieten during the preceding twelve months.
15. Changes
GratisGenieten may change functionalities, wallet rules, cashback rules, voucher structures, campaigns and terms at any time.
New terms are published on the website.
Continued use of the platform constitutes acceptance of the amended terms.
16. Applicable law
These terms are exclusively governed by Dutch law.
Disputes are submitted to the competent court in the Netherlands.
